Frage: Wie lautet die Fatwaüber das Aufhängen eines Bildes an die Wand? Wie ist die Fatwa über den Besitz von Bildern mit Menschen darauf?
Antwort: Es ist nicht erlaubt, ein Bild eines Wesens, das eine Seele besitzt aufzuhängen oder zu behalten. Es ist eine Pflicht, solche Bilder zu zerstören. Denn der Prophet sagte zu ´Ali (ra):
" لا تدع صورة إلاّ طمستها "
„Lass kein Bild, sondern [statt dessen] tilge es."[1]
Es wird in dem Hadith von Ğabir ebenfalls festgestellt, dass:
" ان النّبيّ صلى الله عليه و سلّم نهى عن الصورة في البيت "
„Der Prophet verbot, Bilder in den Häusern zu haben."[2]
Aus diesem Grund sollten alle Bilder, die als Erinnerung aufgehoben werden, in Stücke gerissen oder verbrannt werden. Bilder allerdings, die zu einem bestimmten Zweck gebraucht werden, wie zur offiziellen Identifizierung usw., dürfen behalten werden.

The scholars are those who possess knowledge of the Laws of Allah, who have understanding of the religion and act by their knowledge.
many people these days raise the scholars above criticism saying that their flesh is poisonous and who are you to criticise them
all acts of every person can be measured on the scale of Quran & Sunnah and given the rule of Allah, nobody is infaliablle and nobody's flesh is poisnous
Many people these days follow the scholars of Sultan who forbid which is lawful and make the lawful forbidden to satisfy their rulers and yet we find people stand and defend them thinking that those who taught them Islam can not be wrong but the reality is they can be wrong
most of todays scholars are scholars of Sultans

The first ones to introduce (celebration of the Mawlid) in Cairo were the Faatimid caliphs in the fourth century AH. They introduced the celebration of six birthdays: the Prophet's birthday, the birthday of Imam 'Ali (may Allah be pleased with him), the birthday of Faatimah az-Zahra' (may Allah be pleased with her), the birthdays of al-Hasan and al-Husayn (may Allah be pleased with them), and the birthday of the current caliph.
These celebrations continued to be observed until they were abolished by al-Afdal, the commander of the army. Then they were restored during the caliphate of al-Aamir bi-Ahkaam Allah in 524 AH, after the people had almost forgotten about them.
The first one to introduce celebration of the Prophet's birthday in the city of Irbil was al-Malik al-Muzaffar Abu Sa'eed in the seventh century. And the people beganto go too far in celebration of the Prophet's birthday and introduced everything they themselves desired and everything prompted by the devils among mankind and the jinn.

PARWAN, Jan. 13 – The invading forces while on foot patrol have come under Mujahideen surprise attack in Afghanistan's northern Parwan province, triggering a gunfight of about 30 minutes that has left a dozen of the invaders dead and wounded.
The fight occurred in Siyagard district of the province after a group of the cowardly invaders walked into Mujahideen ambush, says the report, adding that no Mujahideen were harmed in the ensuing firefight.

سب سے پہلى بات تو يہ ہے كہ علماء كرام كا نبى كريم صلى اللہ عليہ وسلم كى تاريخ پيدائش ميں اختلاف پايا جاتا ہے اس ميں كئى ايك اقوال ہيں جہيں ہم ذيل ميں پيش كرتے ہيں:
چنانچہ ابن عبد البر رحمہ اللہ كى رائے ہے كہ نبى كريم صلى اللہ عليہ وسلم كى پيدائش سوموار كے دن دو ربيع الاول كو پيدا ہوئے تھے.
اور ابن حزم رحمہ اللہ نے آٹھ ربيع الاول كو راجح قرار ديا ہے.
اور ايك قول ہے كہ: دس ربيع الاول كو پيدا ہوئے، جيسا كہ ابو جعفر الباقر كا قول ہے.
اور ايك قول ہے كہ: نبى كريم صلى اللہ عليہ وسلم كى پيدائش بارہ ربيع الاول كو ہوئى، جيسا كہ ابن اسحاق كا قول ہے.
اور ايك قول ہے كہ: نبى كريم صلى اللہ عليہ وسلم كى پيدائش رمضان المبارك ميں ہوئى، جيسا كہ ابن عبد البر نے زبير بكّار سے نقل كيا ہے.

ہمارے علم كے ليے علماء كا يہى اختلاف ہى كافى ہے كہ نبى كريم صلى اللہ عليہ وسلم سے محبت كرنے والے اس امت كے سلف علماء كرام تو نبى كريم صلى اللہ عليہ وسلم كى پيدائش كے دن كا قطعى فيصلہ نہ كر سكے، چہ جائيكہ وہ جشن ميلاد النبى صلى اللہ عليہ وسلم مناتے، اور پھر كئى صدياں بيت گئى ليكن مسلمان يہ جشن نہيں مناتے تھے، حتى كہ فاطميوں نے اس جشن كى ايجاد كى.
شيخ على محفوظ رحمہ اللہ كہتے ہيں:
" سب سے پہلے يہ جشن فاطمى خلفاء نے چوتھى صدى ہجرى ميں قاہر ميں منايا، اور انہوں نے ميلاد كى بدعت ايجاد كى جس ميں ميلاد النبى صلى اللہ عليہ وسلم، اور على رضى اللہ تعالى عنہ كى ميلاد، اور فاطمۃ الزہراء رضى اللہ تعالى عنہا كى ميلاد، اور حسن و حسين رضى اللہ تعالى عنہما، اور خليفہ حاضر كى ميلاد، منانے كى بدعت ايجاد كى، اور يہ ميلاديں اسى طرح منائى جاتى رہيں حتى كہ امير لشكر افضل نے انہيں باطل كيا.
اور پھر بعد ميں خليفہ آمر باحكام اللہ كے دور پانچ سو چوبيس ہجرى ميں دوبارہ شروع كيا گيا حالانكہ لوگ تقريبا اسے بھول ہى چكے تھے.
اور سب سے پہلا شخص جس نے اربل شہر ميں ميلاد النبى صلى اللہ عليہ وسلم كى ايجاد كى وہ ابو سعيد ملك مظفر تھا جس نے ساتويں صدى ہجرى ميں اربل كے اندر منائى، اور پھر يہ بدعت آج تك چل رہى ہے، بلكہ لوگوں نے تو اس ميں اور بھى وسعت دے دى ہے، اور ہر وہ چيز اس ميں ايجاد كر لى ہے جو ان كى خواہش تھى، اور جن و انس كے شياطين نے انہيں جس طرف لگايا اور جو كہا انہوں وہى اس ميلاد ميں ايجاد كر ليا " انتہى

دوم:
سوال ميں ميلاد النبى كے قائلين كا يہ قول بيان ہوا ہے كہ:
جو تمہيں كہے كہ ہم جو بھى كرتے ہيں اس كا نبى كريم صلى اللہ عليہ وسلم يا عہد صحابہ يا تابعين ميں پايا جانا ضرورى ہے "
اس شخص كى يہ بات اس پر دلالت كرتى ہے كہ ايسى بات كرنے والے شخص كو تو بدعت كے معنى كا ہى علم نہيں جس بدعت سے ہميں رسول كريم صلى اللہ عليہ وسلم نے بچنے كا بہت سارى احاديث ميں حكم دے ركھا ہے؛ اس قائل نے جو قاعدہ اور ضابطہ ذكر كيا ہے وہ تو ان اشياء كے ليے ہے جو اللہ كا قرب حاصل كرنے كے ليے كى جاتى ہيں يعنى اطاعت و عبادت ميں يہى ضابطہ ہو گا.
اس ليے كسى بھى ايسى عبادت كے ساتھ اللہ كا قرب حاصل كرنا جائز نہيں جو ہمارے ليے رسول كريم صلى اللہ عليہ وسلم نے مشروع نہيں كى، اور يہ چيز نبى كريم صلى اللہ عليہ وسلم نے جو ہميں بدعات سے منع كيا ہے اسى سے مستنبط اور مستمد ہے، اور بدعت اسے كہتے ہيں كہ: كسى ايسى چيز كے ساتھ اللہ كا قرب حاصل كرنے كى كوشش كى جائے جو اس نے ہمارے ليے مشروع نہيں كى، اسى ليے حذيفہ رضى اللہ تعالى عنہ كہا كرتے تھے:
" ہر وہ عبادت جو رسول كريم صلى اللہ عليہ وسلم كے صحابہ كرنے نے نہيں كى تم بھى اسے مت كرو "
يعنى: جو رسول كريم صلى اللہ عليہ وسلم كے دور ميں دين نہيں تھا، اور نہ ہى اس كے ساتھ اللہ كا قرب حاصل كيا جاتا تھا تو اس كے بعد بھى وہ دين نہيں بن سكتا "
پھر سائل نے جو مثال بيان كى ہے وہ جرح و تعديل كے علم كى ہے، اس نے كہا ہے كہ يہ بدعت غير مذموم ہے، جو لوگ بدعت كى اقسام كرتے ہوئے بدعت حسنہ اور بدعت سئيہ كہتے ہيں ان كا يہى قول ہے كہ يہ بدعت حسنہ ہے، بلكہ تقسيم كرنے والے تو اس سے بھى زيادہ آگے بڑھ كر اسے پانچ قسموں ميں تقسيم كرتے ہوئے احكام تكليفيہ كى پانچ قسميں كرتے ہيں:
وجوب، مستحب، مباح، حرام اور مكروہ عزبن عبد السلام رحمہ اللہ يہ تقسيم ذكر كيا ہے اور ان كے شاگرد القرافى نے بھى ان كى متابعت كى ہے.
اور شاطبى رحمہ اللہ قرافى كا اس تقسيم پر راضى ہونے كا رد كرتے ہوئے كہتے ہيں:
" يہ تقسيم اپنى جانب سے اختراع اور ايجاد ہے جس كى كوئى شرعى دليل نہيں، بلكہ يہ اس كا نفس متدافع ہے؛ كيونكہ بدعت كى حقيقت يہى ہے كہ اس كى كوئى شرعى دليل نہ ہو نہ تو نصوص ميں اور نہ ہى قواعد ميں، كيونكہ اگر كوئى ايسى شرعى دليل ہوتى جو وجوب يا مندوب يا مباح وغيرہ پر دلالت كرتى تو پھرى كوئى بدعت ہوتى ہى نہ، اور عمل سارے ان عمومى اعمال ميں شامل ہوتے جن كا حكم ديا گيا ہے يا پھر جن كا اختيار ديا گيا ہے، چنانچہ ان اشياء كو بدعت شمار كرنے اور يہ كہ ان اشياء كے وجوب يا مندوب يا مباح ہونے پر دلائل دلالت كرنے كو جمع كرنا دو منافى اشياء ميں جمع كرنا ہے اور يہ نہيں ہو سكتا.
رہا مكروہ اور حرام كا مسئلہ تو ان كا ايك وجہ سے بدعت ہونا مسلم ہے، اور دوسرى وجہ سے نہيں، كيونكہ جب كسى چيز كے منع يا كراہت پر كوئى دليل دلالت كرتى ہو تو پھر اس كا بدعت ہونا ثابت نہيں ہوتا، كيونكہ ممكن ہے وہ چيز معصيت و نافرمانى ہو مثلا قتل اور چورى اور شراب نوشى وغيرہ، چنانچہ اس تقسيم ميں كبھى بھى بدعت كا تصور نہيں كيا جا سكتا، الا يہ كہ كراہت اور تحريم جس طرح اس كے باب ميں بيان ہوا ہے.
اور قرافى نے اصحاب سے بدعت كے انكار پر اصحاب سے جو اتفاق ذكر كيا ہے وہ صحيح ہے، اور اس نے جو تقسيم كى ہے وہ صحيح نہيں، اور اس كا اختلاف سے متصادم ہونے اور اجماع كو ختم كرنے والى چيز كى معرفت كے باوجود اتفاق ذكر كرنا بہت تعجب والى چيز ہے، لگتا ہے كہ اس نے اس تقسيم ميں اپنے بغير غور و فكر كيے اپنے استاد ابن عبد السلام كى تقليد و اتباع كى ہے.
پھر انہوں نے اس تقسيم ميں ابن عبد السلام رحمہ اللہ كا عذر بيان كيا ہے اور اسے " المصالح المرسلۃ " كا نام ديا ہے كہ يہ بدعت ہے، پھر كہتے ہيں:
" ليكن اس تقسيم كو نقل كرنے ميں قرافى كا كوئى عذر نہيں كيونكہ انہوں نے اپنے استاد كى مراد كے علاوہ اس تقسيم كو ذكر كيا ہے، اور نہ ہى لوگوں كى مراد پر بيان كيا ہے، كيونكہ انہوں نے اس تقسيم ميں سب كى مخالفت كى ہے، تو اس طرح يہ اجماع كے مخالف ہوا " انتہى

ہم نصيحت كرتے ہيں كہ آپ كتاب سے اس موضوع كا مطالعہ ضرور كريں كيونكہ رد كے اعتبار سے يہ بہت ہى بہتر اور اچھا ہے اس ميں انہوں نے فائدہ مند بحث كى ہے.
عز عبد السلام رحمہ اللہ نے بدعت واجبہ كى تقسيم كى مثال بيان كرتے ہوئے كہا ہے:
" بدعت واجبہ كى كئى ايك مثاليں ہيں:
پہلى مثال:
علم نحو جس سے كلام اللہ اور رسول اللہ كى كلام كا فہم آئے ميں مشغول ہونا اور سيكھنا يہ واجب ہے؛ كيونكہ شريعت كى حفاظت واجب ہے، اور اس كى حفاظت اس علم كو جانے بغير نہيں ہو سكتى، اور جو واجب جس كے بغير پورا نہ ہو وہ چيز بھى واجب ہوتى ہے.
دوسرى مثال:
كتاب اللہ اور سنت رسول صلى اللہ عليہ وسلم ميں سے غريب الفاظ اور لغت كى حفاظت كرنا.
تيسرى مثال:
اصول فقہ كى تدوين.
چوتھى مثال:
جرح و تعديل ميں كلام كرنا تا كہ صحيح اور غلط ميں تميز ہو سكے، اور شرعى قواعد اس پر دلالت كرتے ہيں كہ شريعت كى حفاظت قدر متعين سے زيادہ كى حفاظت فرض كفايہ ہے، اور شريعت كى حفاظت اسى كے ساتھ ہو سكتى ہے جس كا ہم نے ذكر كيا ہے " انتہى.

اور شاطبى رحمہ اللہ بھى اس كا رد كرتے ہوئے كہتے ہيں:
" اور عز الدين نے جو كچھ كہا ہے: اس پر كلام وہى ہے جو اوپر بيان ہو چكى ہے، اس ميں سے واجب كى مثاليں اسى كے حساب سے ہيں كہ جو واجب جس كے بغير واجب پورا نہ ہوتا ہو تو وہ چيز بھى واجب ہے ـ جيسا اس نے كہا ہے ـ چنانچہ اس ميں يہ شرط نہيں لگائى جائيگى كہ وہ سلف ميں پائى گئى ہو، اور نہ ہى يہ كہ خاص كر اس كا اصل شريعت ميں موجود ہو؛ كيونكہ يہ تو مصالح المرسلہ كے باب ميں شامل ہے نہ كہ بدعت ميں " انتہى.

اور اس رد كا حاصل يہ ہوا كہ:
ان علوم كو بدعت شرعيہ مذمومہ كے وصف سے موصوف كرنا صحيح نہيں، كيونكہ دين اور سنت نبويہ كى حفاظت والى عمومى شرعى نصوص اور شرعى قواعد سے ان كى گواہى ملتى ہے اور جن ميں شرعى نصوص اور شرعى علوم ( كتاب و سنت ) كو لوگوں تك صحيح شكل ميں پہچانے كا بيان ہوا ہے اس سے بھى دليل ملتى ہے.
اور يہ بھى كہنا ممكن ہے كہ: ان علوم كو لغوى طور پر بدعت شمار كيا جا سكتا ہے، نا كہ شرعى طور پر بدعت، اور شرعى بدعت سارى مذموم ہى ہيں، ليكن لغوى بدعت ميں سے كچھ تو محمود ہيں اور كچھ مذموم.
حافظ ابن حجر رحمہ اللہ كہتے ہيں:
" شرعى عرف ميں بدعت مذ موم ہى ہے، بخلاف لغوى بدعت كے، كيونكہ ہر وہ چيز جو نئى ايجاد كى گئى اور اس كى مثال نہ ہو اسے بدعت كا نام ديا جاتا ہے چاہے وہ محمود ہو يا مذموم " انتہى

حافظ ابن حجر رحمہ اللہ كا يہ بھى كہنا ہے:
" البدع يہ بدعۃ كى جمع ہے، اور بدعت ہر اس چيز كو كہتے ہيں جس كى پہلے مثال نہ ملتى ہو، لہذا لغوى طور پر يہ ہر محمود اور مذموم كو شامل ہو گى، اور اہل شرع كے عرف ميں يہ مذموم كے ساتھ مختص ہو گى، اگرچہ يہ محمود ميں وارد ہے، ليكن يہ لغوى معنى ميں ہو گى " انتہى

اور صحيح بخارى كتاب الاعتصام بالكتاب و السنۃ باب نمر 2حديث نمبر ( 7277 ) پر حافظ ابن حجر رحمہ اللہ كى تعليق پر شيخ عبد الرحمن البراك حفظہ اللہ كہتے ہيں:
" يہ تقسيم لغوى بدعت كے اعتبار سے صحيح ہے، ليكن شرع ميں ہر بدعت گمراہى ہے، جيسا كہ نبى كريم صلى اللہ عليہ وسلم كا فرمان ہے:
" اور سب سے برے امور دين ميں نئے ايجاد كردہ ہيں، اور ہر بدعت گمراہى ہے "
اور اس عموم كے باوجود يہ كہا جائز نہيں كہ كچھ بدعات واجب ہوتى ہيں يا مستحب يا مباح، بلكہ دين ميں يا تو بدعت حرام ہے يا پھر مكروہ، اور مكروہ ميں يہ بھى شامل ہے جس كے متعلق انہوں نے اسے بدعت مباح كہا ہے: يعنى عصر اور صبح كے بعد مصافحہ كرنے كے ليے مخصوص كرنا " انتہى
